Terms and Conditions
Truck and Cargo Salvage Solutions (Pty) Ltd, herein after referred to as T&C.
The Financial Intelligence Centre Act (” FICA”) requires some institutions, such as Truck and Cargo Salvage Solutions (Pty) Ltd, to establish and verify clients’ identities to combat money laundering and the financing of terrorism. The documentation as set out in the FICA Requirements tab on this website is required by us to comply with the obligations set out in FICA. Please note the requirements may differ depending on the type of entity registering.
You must provide the required documentation to complete the registration process and to be able to bid. All purchaser information received must first be verified by a T&C employee before the purchaser will be allowed to bid. Please check and confirm all your details on your profile as these details will be used to create pro-forma invoices, tax invoices, refunds, and the like.
Please register and provide required FICA documentation as early as possible prior to auction. We recommend at least two days prior.
As part of the registration process, bidders must pay a R10,000.00 registration deposit in order to bid by depositing via Electronic Fund Transfer (EFT) the money in T&C’s account, using your registered name or entity as reference and provide proof via email of such deposit to T&C. Funds must clear into our account before you can bid. Your deposit is fully refundable after conclusion of the auction, into the account details provided at time of registration or can be deducted off any successful purchase.
Where you wish to remain registered as a permanent buyer, such deposit will be retained by T&C until such time that you decide to no longer be registered as a bidder.
Any deposit paid will not attract any interest.
Bids exclude a 10% Buyers Premium, R2,250.00 Document Handling Fee and 15% VAT on the total.
Example: Bid Price R10,000.00 + Buyers Premium R1,000.00 + Document Handling Fee R2,250.00 + VAT R1,987.50 = Total R15,237.50.
A 2% cash handling fee will be charged on all cash deposits made into our account.
All payments must be received into T&C’s bank account within 48 hours after proforma invoice date to finalise the sale. Payments not received in full within the required time, will result in automatic cancellation of sale. Any cancellation by a Purchaser will be deemed a breach of sale.
Any breach of sale or where the bidder has failed to pay in full within 48 hours after proforma invoice date, such bidder will be banned from the auction site and registration will be cancelled. Any registration deposit paid will be forfeited and retained by T&C and the bidder will have no claim against T&C in respect of such deposit.
Should the bidder wish to register for any future auctions, such request will be considered by management and will be subject to a new registration deposit being paid.
All vehicles and goods are sold without reserve but always Subject to Confirmation (STC), which will be confirmed within three working days after the auction has concluded. If no confirmation received within three days after the auction concluded, the bid must be considered unsuccessful.
Bidders will be notified by e-mail if you have won any lots and a Pro-Forma invoice will be generated.
As soon we have received proof of full payment into T&C’s bank account, a VAT Invoice will be generated.
Once we have received proof of full payment into T&C’s bank account, goods purchased can be released.
All items bought must be removed within 7 days of your VAT Invoice being issued. Failure to remove items within the 7 days will result in storage fees being charged to the Purchaser before an item can be released.
Items bought can be collected Monday to Friday between 8am – 3pm, excluding public holidays and weekends. All cost of collection, loading and transport will be for the buyer’s account.
Items bought will only be released to the buyer. We will require written instruction from the buyer to release to any other party.
All risk of loss or damage, irrespective of cause, to any item bought on auction will transfer to the buyer as soon as the buyer is issued with T&C’s proforma invoice. T&C does not accept liability for loss or damage whatsoever, irrespective of cause of loss.
T&C will endeavour to do change of ownership or dealerstock to the buyer at relevant licensing authorities as soon as the sale is concluded. However, where we have not done so, the buyer must ensure it is done within 21 days of your purchase as per the Road Traffic Act 1989. Failure to change ownership within 21 days will result in your T&C auction registration being cancelled and possible deregistration of the subject vehicle. T&C will complete Change of Ownership for you, and courier your registration documents to you. Please ensure your address on your profile is correct as this is where we will send the registration documents.
Registration Papers will only be released to the buyer, unless we have received written instructions from the buyer authorising us to release the Registration Papers to a third party.
Any fines and penalties on vehicles incurred after the buyer has collected the vehicle from our premises will be for the account of the buyer.
All items are sold as salvage, As Is (Voetstoots), irrespective of condition. There are no guarantees or warrantees on any item. All items sold on auction must be considered accident damaged. All parts and components must be considered damaged and possibly missing, stolen or swopped. All items are sold in the condition they are in on the day of auction. Bidders hereby acknowledge that they have familiarised themselves with the condition of the vehicle prior to auction.
Any photograph published of an item in support of the auction is for illustration purposes only and might not be reflective of the condition of the item on the day of auction.
T&C does not take any responsibility for any item, part or component that is missing, damaged or swopped where the bidder might claim that such item was intact prior to date of auction.
We strongly encourage all buyers to visit our premises to inspect the items they wish to bid on before making a purchase.
The date of first registration on the registration papers is not always reflective of the year of manufacture. The onus is on the buyer to check and ensure that the year of manufacture or date of rebuilt is what he requires.
License discs and number plates will be removed prior to any vehicle which has been sold exits our premises.
Bidders may view all vehicles online at www.truckandcargo.co.za No need to register to view any items on auction.
The buyer must remove all company branding from vehicles before such vehicle is used on the road again. Failure to do so will result in the buyer being liable for all loss or costs incurred which might stem from such use.
Our Terms and Conditions apply to all persons entering our premises, users on our website, registered legal entities, bidders and buyers, and the Terms and Conditions will be deemed accepted upon entry to our premises or when any transaction on our website occurs.
Right of admission to any T&C premises, as well as our website is reserved. We reserve the right to cancel any account or ask a person to leave our premises.
All vehicles and persons entering and exiting any of our premises may be searched.
T&C accepts no liability for loss or damage resulting from interruption of internet connectivity.
T&C reserves the right to control and regulate bidding, and to withdraw an item or cancel a sale at any time.
Auctions may extend automatically as they are about to expire to ensure everybody had a fair change to place their bids.
For all purposes, including litigation, relating to, and arising from these Terms and Conditions, the buyer determines as his/her Domicile Citandi et Executandi the address given by him/her at the time of registration, and which is accepted by the registered user.
T&C website, as well as our auctions, are operated in the Republic of South Africa, and all local laws will apply. In the event of a dispute, the North Gauteng High court will be used.
No verbal agreements will be binding.
All our premises are working yards. T&C will not accept any liability for any loss, damage or injuries howsoever incurred whilst you are on any of our premises.
